Official Press Release on Austin Smith

L’HCB Alto Adige Alperia ha preso atto con stupore, incredulità ed amarezza delle dichiarazioni ed esternazioni rilasciate e pubblicate negli ultimi giorni dal suo ex giocatore Austin Smith, dichiarazioni che la società respinge e contesta con fermezza perché assolutamente infondate e non veritiere e si riserva di agire in tutte le sedi competenti a tutela della sua immagine e reputazione e di quelle dei suoi tesserati e collaboratori.

Ancora più deplorevole risulta la circostanza secondo la quale le iniziative diffamatorie del sig. Austin Smith paiono essere causate da pretese economiche per premi ancora da verificare, avendo l’HCB adempiuto al pagamento di tutti gli emolumenti contrattualmente previsti, peraltro con premi più alti rispetto ad altri contratti.

L’HCB ha ringraziato il sig. Austin Smith per il contributo comunque dato nella stagione 2017/2018, e formula i migliori auguri per il suo percorso futuro, ma come già detto, non può e non vuole accettare le sue affermazioni gravemente lesive ed offensive e precisa quanto segue:

• Austin Smith è stato ingaggiato dall’HCB per la stagione 2017/2018, confidando nelle sue doti di realizzatore, dopo aver superato il check medico sportivo, anche se l’HCB era a conoscenza che il giocatore a Ravensburg (DEL2) in una stagione precedente aveva avuto interruzioni di attività agonistica di una certa rilevanza.
• Il giocatore ha lamentato un primo malessere in data 20.10.2017 dopo la partita contro i Vienna Capitals a Vienna, pur non essendosi rilevati checks, altri falli a suo carico o incidenti da lui subiti, come riscontrabile anche dalla visione del filmato della partita e difatti Austin Smith, in seguito, non ha lamentato il perdurare di sintomi e tantomeno di quelli di una eventuale commozione cerebrale; di sua spontanea volontà ha affrontato il trasferimento da Vienna a Znojmo, giocando regolarmente il giorno seguente la partita contro lo Znojmo, segnando un gol e fornendo un assist.
• Soltanto dopo la partita del 27.10.2017 a Bolzano contro il Klagenfurt, dove ha fornito due assist, il giocatore ha nuovamente lamentato malessere e da quel giorno non ha più partecipato a partite di campionato dell’HCB fino al 12.01.2018, come sotto più dettagliatamente descritto.
• Subito dopo la partita del 27.10.2017 ed il giorno seguente, il giocatore è stato attentamente visitato dallo staff medico dell’HCB, senza evidenze cliniche.
• In data 29 e 31.10.2017, il giocatore lamentava il persistere di malessere (“dizziness”) e quindi lo staff medico ha programmato una serie di accertamenti e visite specialistiche, rimaste tutte con esiti negativi, disponendo comunque subito la sospensione dall’attività fisica dello stesso:
  • il 04.11.2017, durante una visita disposta dallo staff medico dell’HCB nell’ospedale di Bolzano, veniva confermata una pausa agonistica di due settimane;
  • il 07.11.2017 venivano effettuate presso una struttura privata altamente specializzata una CT e un MRI, tutte con esiti negativi;
  • alcuni giorni dopo veniva disposta una visita otorinolaringoiatrica, anche essa con esito negativo.
• Nonostante nessuna evidenza clinica di una eventuale commozione cerebrale, lo staff medico dell’HCB aveva, prudenzialmente, già applicato il protocollo internazionale in oggetto prescrivendo il riposo assoluto per due settimane e il divieto di uso di apparecchiature elettroniche.
• Alla fine di novembre, il sig. Austin Smith, su sua richiesta, a ciò espressamente autorizzato dalla società, si recò in Canada, per sottoporsi alla visita di un suo fiduciario in data 26.11.2017 – che, però, dalle informazioni assunte, non risulta essere medico e tantomeno medico specialista – che individuava possibili c.d. microconcussions.
• Dopo alcuni giorni il sig. Austin Smith tornò dal Canada con l’indicazione di osservare un’ulteriore pausa di 8-10 giorni (lo staff medico dell’HCB parlava di almeno ulteriori due settimane), e di sottoporsi a delle sedute osteopatiche dichiarandosi comunque vicino al rientro in squadra.
• Ciononostante, il giocatore volle recarsi presso uno specialista di sua fiducia di Hannover, a ciò autorizzato nuovamente dall’HCB, ove venne confermata, riduttivamente, la prescrizione dello staff medico dell’HCB con ulteriori 8-10 giorni di riposo.
• Il giocatore è rimasto sotto costante controllo dello staff medico della società e la stessa gli ha reso possibile l’accesso continuo ad una rinomata struttura medico/sanitaria, il Medical Center Quellenhof, ove collabora uno dei medici dell’HCB, e dove gli sono stati praticati ripetutamente trattamenti fisioterapici, osteopatici e massaggi; sono pure state effettuate analisi del sangue, delle urine e ripetuti controlli con occhiali di Frenzel, rimanendo il dottore a disposizione del giocatore praticamente 24 ore al giorno.
• A partire dall’08.01.2018, la società ha messo a disposizione del giocatore un osteopata/fisioterapista personale, molto conosciuto e considerato, poi anche dal giocatore stesso, che lo ha seguito più volte la settimana ed in seguito anche durante molte partite che aveva giocato a partire da gennaio.
• Il giocatore aveva ripetutamente, già verso la fine di dicembre, espresso il desiderio di riprendere l’attività agonistica, ma lo staff medico lo ha tenuto fermo fino al 12.01.2018 quando lo stesso giocatore ha dichiarato con fermezza di sentirsi bene e di voler giocare.
• Inaspettatamente e senza evidenze alcuna, salvo le vaghe indicazioni di malessere, il 14, 19 e 20 gennaio 2018 il giocatore non partecipò alle partite del campionato con la squadra; continuavano il monitoraggio dello staff medico dell’HCB, i trattamenti dell’osteopata personale e le cure presso il citato Medical Center Quellenhof.
• In seguito, il sig. Austin Smith ha ripreso a giocare il 26.01.2018 (1 gol e 1 assist) ed a seguire 10 partite di fila (7 gol e 2 assist) del Qualification Round. Ha poi giocato 6 partite nei quarti di finale (2 gol e 3 assist), 4 partite su 5 delle semifinali (1 gol e 1 assist – ad una partita non ha partecipato per i soliti motivi di dichiarato malessere) e 6 partite su 7 delle finali (1 gol e 2 assist – ad una partita non si è presentato alla partenza del pullman per Salisburgo e quindi non ha giocato, comunicando solo all’ultimo momento di non sentirsi bene; nella partita delle finali del 09.04.2018 a Salisburgo, dopo il secondo tempo, è rimasto in cabina senza aver subito incidenti o infortuni, semplicemente per uno stato emotivo alterato).
• il sig. Austin Smith, nel frattempo, pare fosse già entrato in contatto con altra squadra partecipante al campionato EBEL, firmando in seguito un contratto, che poi ha risolto, come riportato dai media.

Concludendo, l’HCB conferma e dichiara che:

• non c’è stato mai un giocatore tesserato per la società che ha avuto un’attenzione, un’assistenza medico/sanitaria ed un trattamento personalizzato come il sig. Austin Smith, che alla partenza da Bolzano ha espressamente ringraziato un medico dello staff dell’HCB per l’assistenza ricevuta;
• lo staff medico dell’HCB ha adottato tutte le misure idonee – diagnostico terapeutiche – per il caso in oggetto (anche per l’eventualità di una, mai accertata, commozione cerebrale), prescrivendo periodi di riposo ben più lunghi di quelli previsti dai protocolli internazionali e suggeriti dai consulenti esterni consultati dallo stesso Austin Smith;
• lo staff medico non ha mai imposto l’uso di farmaci, come invece sostenuto falsamente dal giocatore; va anzi rimarcato che il giocatore, alla visita medico sportiva contrattuale, aveva sottaciuto il ricorso in passato a farmaci riferibili ai suoi malesseri, come dichiarati;
• per rispetto e tutela della privacy del sig. Austin Smith, si può unicamente sottolineare che per un chiarimento dello stato di salute del sig. Austin Smith, si debbono considerare, verificare ed approfondire pregresse, serie situazioni cliniche dello stesso;
• non lo ha mai forzato a giocare, anzi, lo ha fermato, anche precauzionalmente, più di quanto ipotizzabile (vedasi sopra) ed il giocatore ha giocato solamente quando si è sentito di farlo.

L’HCB è in ogni momento in grado di provare e documentare quanto sopra esposto e ribadisce di voler tutelare in tutte le sedi competenti l’immagine, la reputazione e l’onorabilità della società, dello staff medico e dei suoi collaboratori.

The HCB Südtirol Alperia acknowledges with surprise, astonishment and consternation the declarations and statements made by its former player Austin Smith over the last days and firmly rejects them as totally unfounded and incorrect. The Club reserves its rights to take legal steps against it through all the competent authorities, in order to protect the image and the reputation of the Club, and of its staff members.

The events are even more regrettable, as everything is indicating that the defamatory declarations of Mister Austin Smith have its true reasons in bonus claims, which are currently under review, although HCB paid out all the emoluments and bonuses specified in the contract, which were significantly higher than in other player contracts.

The HCB thanks Mister Austin Smith for his contribution during the season 2017/18 and wishes him all the best for his future, but as already mentioned, HCB cannot and will not accept his heavily damaging and hurting statements and therefore replies as following:

• Austin Smith, after passing the mandatory medical check-up, was taken under contract for the season 2017/18, as the Club trusted on his goal getting qualities, although at that moment HCB was informed about significant interruptions in his competition related activities in a previous season in Ravensburg (DEL2).
• The first time the player complained about a discomfort was on October 20^th2017, after a game against the Vienna Capitals in Vienna, although during the mentioned game no hits or other fouls against him, or any other type of incident could be ascertained, even after a detailed review of the video footage of the game. In succession the player didn’t complain about any symptoms, especially not about any symptoms relatable to a concussion and on his own volition he continued the road trip with the team to Znojmo, where he regularly played the day after in the game against Znojmo, scoring one goal and one assist.
• Only after the home game on October 27^th 2017 in Bolzano against Klagenfurt, where he scored 2 assists, the player complained again to feel discomfort and from that moment on until January 12^th 2018 he did not take part in any official game of the HCB (see following description).
• After the game on October 27^th 2017 and the following day the player was immediately checked by the medical team of the Club, which did not detect any abnormalities.
• On October 29^th and October 31^st 2017 the player complained again about a permanent discomfort (“dizziness”), whereupon the medical team was initiating a series of check-ups and medical specialist visits, all of them without any abnormal results. As a precaution the medical staff imposed an immediate cessation of any sports activity:
  • on November 4^th 2017, during of a check-up imposed by the team doctors of the HCB in the Bolzano hospital, a suspension of any sports activity for 2 weeks was confirmed
  • on November 7^th 2017, in a highly specialized private institution, a CT and MRI scan where made, both with negative results;
  • a few days later neither an ENT brought any positive results.
• Although no clinical proof of a concussion was given, the HCB team doctors immediately and precautionary applied the relevant international protocol, prescribing two weeks of absolute rest and the ban of any electronic devices.
• At the end of November 2017 Mister Austin Smith, upon his specific request and with explicit permission of the Club, flew to Canada, to undergo a check-up by a confidential person, who diagnosed the possibility of so-called “microconcussions”. However, this person turned out not to be a doctor of medicine and especially no specialist doctor.
• After a few days Austin Smith returned from Canada with the recommendation to take a further break of 8 to 10 days (the HCB medical team at that point was already talking about a minimum of two more weeks) and to undergo osteopathic treatments, he was stating at that time that he wants to return to the team as soon as possible
• Despite everything, again with the permission of the HCB, the player went for an additional check up to a specialist of his choice in Hannover, Germany, who confirmed the opinion of the HCB medical team but corrected it down to a break of 8-10 more days.
• The player was still under the constant observation of the medical team of the Club, which also allowed him the permanent access to the Medical Center Quellenhof, a well-known private medical infrastructure, collaborating with one doctor of the HCB medical team and where the player obtained different physiotherapeutic and osteopathic therapies, blood and urine analysis and repeated checks through “Frenzel-glasses”, whereby the above nominated doctor was available for the player basically on a 24/7 base.
• As of January 8^th 2018 the Club provided to the player an established personal Ostheopath/Physiotherapist, very appreciated by the player himself, who followed him several times a week and later on in the season, as he returned to play in January, also during different games.
• On several occasions, the player expressed already at the end of December, his wish to start again with his game activities. The medical team of HCB anyways made him rest until January 12^th 2018. That day the player declared emphatically to feel well and that he wanted to play.
• Completely unforeseeable and without any prognostic symptoms, except unspecific statements to not feel well, the player did not take part in league games scheduled on January 14^th, 19^th, and 20^th 2018. The observation through the HCB team doctors, the personal osteopath and the treatments at the Medical Center Quellenhof where still ongoing in that period.
• Consecutively Austin Smith was playing again for the first time on January 26^th 2018 (1 goal, 1 assist) and in the following 10 games of the qualification round (7 goals, 2 assists). He played in six more games in the quarter finals (2 goals, 3 assists), four out of five semi-final games (1 goal, 1 assist – at one of the games he didn’t participate declaring to not feel well) and six out of seven games of the final series (1 goal and 2 assists – on one game day he did not show up at the start of the bus headed to Salzburg and missed that game, after informing only at the last moment to not feel well, during the finals game on April 9^th 2018 in Salzburg he remained in the locker room after the second period, without any injuries or incidents, as he was in a highly agitated emotional state, not feeling to be able to continue the game).
• Apparently, in the meantime Austin Smith was already in contact with another EBEL team, where consequently he signed a contract, which, in the meanwhile, as published in the media, dissolved again.

Conclusively the HCB declares and affirms as follows:

• no other HCB player has ever experienced such an intense attention and medical/therapeutic support like Austin Smith, who at his departure from Bolzano explicitly thanked one of the doctors of the HCB medical team for the support received.
• The HCB medical team took (even for the not diagnosable case of a concussion) the appropriate diagnostic and therapeutic measures and prescribed longer rephrases as designated by the international protocols and by the external consultants of the player.
• The medical team never forced any intake of medical drugs, opposite statements of the player are untrue, the HCB to the contrary wants to underline that the player during the mandatory, by contract foreseen, sport medical check-up was withholding the previous intake of pharmacies that could be connected to later described discomforts.
• The HCB respects the privacy of the player and therefore limits itself to note that in order to clarify the health conditions of Mister Austin Smith, more serious past diseases have to be considered and evaluated.
• The Club never forced the player Austin Smith to play, but has made him precautionary rest more than suggested, the player was only allowed to play when he explicitly declared his ability.

The HCB can prove and document all the facts and procedures listed in the present statement and is willing to protect and defend the image and the respectability of the Club, its medical team and its staff members with all the available resources.
